COMPETITION SPECIFIC TERMS AND CONDITIONS: NAMIBIA
1 These are the competition specific terms and conditions for “Nivea® Namibia 2021 Competition (“the Competition”).
2 The promoter of the Competition is Beiersdorf Consumer Products (Pty) Ltd, (with registration number: 2000/010257/07) a company duly incorporated under the company laws of the Republic of South Africa and having its registered place of business situated at 4th Floor, Beacon Rock, 21 Lighthouse Road, Umhlanga Rocks, 4319 (“the Promoter”).
3 The Competition is open to Namibian citizens only and excludes the Promoter, the Promoter’s advertising and promotional agencies, any directors, members, partners, agents, employees or consultants of the Promoter, any supplier of goods or services in connection with the Competition and the spouse, life partner, business partner or associate, parent, child, or sibling, of any of the persons specified aforesaid.
4 The Competition is open from 19 July 2021 and ends on 30 August 2021 (the closing date). Any entries received before 19 July 2021 and after the closing date will not be considered.
5 It is the responsibility of the entrants to ensure that his/her entry is received within the competition dates. Any entries, which are not received before midnight on 30 August 2021 will not be eligible to participate, regardless of the reason for the late entry.
6 The Promoter and its affiliates are not responsible for any entries, which are not received by it, regardless of the cause for non-receipt.
7 The Promoter and its affiliates are not responsible for any problems or technical malfunction of any telephone network, computer system, server, or provider, which may have hindered entry into the Competition.
8 To enter the Competition entrants are required to purchase any 2 (two) NIVEA® products and send a WhatsApp picture of their till slip or receipt to +27 71 556 1158. Entrants are required to retain their till slip as proof of purchase.
9 Entrants are permitted to enter multiple times, subject to each entry being linked to a separate purchase and till slip, as per 8 above.
10 A random electronic draw will take place weekly commencing a week after the 19th July 2021 and ending a week after 30 August 2021, whereby ten (10) eligible winners per week will be drawn from all the valid entries received, to stand a chance of each winning a shopping voucher to the value of N$1000 (One Thousand Namibian Dollars only). 11 The eligible winners will be notified telephonically within 2 (two) weeks of each draw date as per clause 9 above and they will be required to verify their details, submit the till slip evidencing the purchase of the products as per 8 above, and to provide their Namibian ID number and banking details.
12 The Promoter will attempt to contact an eligible winner 3 (three) times over a 72 (seventy two) hour period on the cell phone number used to enter. If an eligible winner cannot be contacted, the chance to win a prize will be forfeited and a backup eligible winner will be drawn and these same terms and conditions shall apply.
13 Eligible winners will have 72 (seventy two) hours from the date on which they were contacted by the Promoter, to verify their details, submit the till slip evidencing the purchase of the products as per 8 above, and to provide their Namibian ID number and banking details, falling which; the chance to win a prize shall be forfeited and a backup eligible winner will be drawn and these same terms and conditions shall apply.
14 The prizes are not exchangeable nor transferable, under any circumstances, unless provided for in these terms and conditions.
15 The Promoter reserves the right to change and/or postpone or terminate the Competition immediately without notice. In the event of such change or termination, all entrants agree to waive any rights that they may have in terms of this Competition and acknowledge that they will have no recourse against the Promoter or its agents or distributors.
16 Neither the Promoter not its agents, distributors, nor any of the Promoter’s directors, officers, employees or agents shall be liable for any loss or damage, whether direct, indirect, consequential or otherwise, arising from any cause whatsoever, which may be suffered by the entrants in connection with this Competition or the use of the prizes.
17 The eligible prize winners may be required to sign an indemnity. Failure to sign the indemnity shall result in the prize being forfeited.
18 All risks and ownership of the prizes shall pass to the winners on transfer/delivery thereof and hence all of The Promoter’s obligations in regard to the Competition as well as in regard to the prizes shall terminate.
19 The Promoter shall not be liable for any costs incurred by the entrants and eligible winners for entering the Competition or in claiming any prizes, where applicable.
20 All the information provided or related to this Competition shall be managed, captured and approved by the Promoter, and will not be used for any other purpose than for execution of the Competition and in line with applicable legislation.
22 Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the participant or the Promoter in terms of the Consumer Protection Laws (“CPL”).
23 By entering the Competition, entrants acknowledge that the Competition will be managed in accordance with the provisions of the CPL. Qualifying entrants undertake to expeditiously do all things necessary to enable the Promoter to comply with their obligations under the CPL.
24 The Promotor’s decision(s) shall be final and no correspondence will be entered into.
